1. Acceptance of Terms
By accessing or using Deayan Products (accessible at deayan.com and affiliated subdomains), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the platform. The following terms are specific, but not limited, to DeayanXtra: accessible at xtra.deayan.com.
2. Description of Platform & Workstations
DeayanXtra provides browser-based generative visual effect engines, typographic kinetic workstations, and other asset generators for digital video editors, motion designers, and creators.
- Free Tier: Requires a registered account to execute free workstations (also referred to as effects). Free tools are provided without watermarks or export restrictions within their published functional parameters.
- Pro Pass (Paid Tier): Unlocks unrestricted access to all current and future premium workstations, exports up to the maximum resolution each pack supports, and transparent video sequence exporters (depending on the effect being used).
3. Local Client-Side Execution & Hardware Disclaimer
Because computation is performed entirely on your device, rendering speeds, export durations, and viewport fluidities are directly dependent on your system's hardware specifications (GPU, RAM, and browser WebGL performance). DeayanXtra has no control over individual machine capabilities and makes no guarantees regarding rendering duration on hardware that falls below modern graphical standards.
4. Intellectual Property & Commercial Licensing
Your Rendered Output: You retain 100% full commercial ownership and distribution rights to all media, videos, images, and sequence renders created using DeayanXtra workstations. You may use outputs for client work, commercial advertisements, films, and personal projects royalty-free.
Platform Ownership: All proprietary WebGL shader code, user interface designs, mathematical simulation models, branding, logos, and platform architectures remain the exclusive intellectual property of DeayanXtra. You may not decompile, reverse-engineer, scrape, redistribute, or resell the raw underlying code or workstations as standalone software.
5. Subscription Billing, Auto-Renewal & Grandfather Clause
Pro Pass subscriptions are billed on a recurring monthly basis. By activating a subscription, you authorize automatic recurring charges to your payment method at the beginning of each billing cycle.
Grandfathered Rate Guarantee: If you enrolled under an Early-Bird or discounted promotional rate, your subscription fee will not increase as long as your membership remains continuously active. If you cancel your membership or if a renewal payment fails, your locked rate is permanently forfeited.
Subscriptions can be cancelled at any time from your Account Dashboard in accordance with our Refund & Cancellation Policy.
6. Account Security
You are responsible for maintaining the confidentiality of your login credentials. Sharing account access with third parties or attempting to bypass platform gatekeeping mechanisms is strictly prohibited and grounds for immediate termination without notice.
7. Limitation of Liability
DeayanXtra is provided on an "as-is" and "as-available" basis without warranties of any kind. Under no circumstances shall Deayan (DeayanXtra) or its operators be liable for any indirect, incidental, consequential, or punitive damages resulting from your use of, or inability to use, the platform.
8. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
